1. Acceptance of Terms

By accessing or using PTEasy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including but not limited to registered users, subscribers, and content contributors.

2. Eligibility

To use PTEasy, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

If you are under 18, you must have parental or guardian consent to use the Service.

3. Account Registration

Account Creation

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use

Account Restrictions

• One account per person
• Accounts are non-transferable
• You may not share your account credentials
• You may not use another person's account

4. Services Description

PTEasy provides:

• PTE exam preparation materials and exercises
• Mock tests simulating the actual PTE exam
• AI-powered scoring and feedback
• Progress tracking and analytics
• Study plans and recommendations

5. Payment & Subscriptions

Subscription Plans

We offer various subscription tiers:

New web accounts receive seven days of Premium at no charge and without a payment card. Unless you choose a paid plan, trial access ends automatically and the account continues on Free; no automatic charge is made.

• Free: Limited access to individual exercises
• Premium: Unlimited AI scoring, 10 mock tests per month, limited AI Coach access, and detailed insights
• Pro: Unlimited AI scoring and mock tests, comprehensive AI Coach access with higher usage limits, and advanced analytics
• Enterprise: Custom pricing for institutions

Billing Terms

• Payment is due at the beginning of each billing cycle
• All fees are non-refundable except as required by law
• We reserve the right to change prices with 30 days notice

Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are provided for unused time.

6. User Content

Your Content

You retain ownership of content you submit, including:

• Written responses to exercises
• Audio recordings for speaking exercises
• Profile information and study notes

License Grant

By submitting content, you grant PTEasy a worldwide, non-exclusive, royalty-free license to use, reproduce, and analyze your content for:

• Providing and improving our services
• Generating scores and feedback
• Research and development purposes
• Creating anonymized aggregate data

7. User Conduct

Acceptable Use

You agree to use PTEasy only for lawful purposes and in accordance with these Terms.

Prohibited Activities

You may not:

• Share or distribute copyrighted content without permission
• Use automated systems to access the Service
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer or decompile any part of the Service
• Use the Service for any commercial purpose without permission
• Impersonate another person or entity
• Collect or harvest user information
• Upload malicious code or viruses

8. Intellectual Property

PTEasy Property

The Service and its original content (excluding user content), features, and functionality are and will remain the exclusive property of PTEasy. The Service is protected by copyright, trademark, and other laws.

Trademarks

PTEasy name, logo, and all related names, logos, product and service names are trademarks of PTEasy. You may not use these marks without our prior written permission.

9. Privacy

Your use of PTEasy is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

10. Disclaimers

No Guarantee of Results

PTEasy does not guarantee any specific test scores or outcomes. Success in the PTE exam depends on many factors beyond our control, including individual effort, aptitude, and test-day performance.

11. Limitation of Liability

To the maximum extent permitted by law, PTEasy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Test performance or scores
• Interruption of business
• Cost of substitute services

Our total liability shall not exceed the amount paid by you to PTEasy in the 12 months preceding the claim.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• At our sole discretion for any reason

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which should reasonably survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of São Paulo, Brazil.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use after changes constitutes acceptance of the new Terms.
